Georgia Athletes Cleared for NIL Deals Following Arbitration Ruling

The College Sports Commission (CSC) highlighted a recent arbitration ruling as a reinforcement of the impartial arbitration framework established for name, image, and likeness (NIL) transactions in collegiate athletics. On Monday, the CSC shared insights into the decision, which yielded minor successes for both parties involved. The arbitrator sanctioned the NIL agreements for two Georgia athletes after the CSC reevaluated the arrangements, concluding they adhered to its updated compensation guidelines.

Initially, the CSC had rejected the deals, prompting the University of Georgia to escalate the issue to arbitration. However, the arbitrator chose not to explore the breadth of the CSC's authority or to grant Georgia the legal fees incurred during the process. The CSC indicated that while it does not intend to make a routine practice of re-examining agreements, this particular case warranted a second look due to significant changes arising during the arbitration.

In response, Georgia's athletic department expressed satisfaction with the outcome for the athletes but conveyed apprehension regarding the arbitration process. “The CSC approved the agreements only after arbitration had already begun and left important underlying issues unresolved,” the department stated. They also requested compensation for legal expenses, arguing that neither institutions nor student-athletes should incur costs to achieve resolutions deemed acceptable by the CSC.

According to a CSC announcement, the resolution of this case illustrates that the arbitration process operates effectively as designed. This ruling follows a similar decision made four weeks earlier, when an arbitrator sided with the CSC in a case concerning Nebraska football players, which also involved the classification of Nebraska's multimedia-rights partner as an "associated entity" under CSC review.
