Fraud Allegations Emerge in NFL Concussion Settlement Claims
Recent findings have raised serious concerns within the legal community regarding potential fraud tied to concussion settlement claims involving retired NFL players. Robert Klemko from ESPN reports that five law firms representing a total of 98 former players are suspected of orchestrating a scheme to defraud the NFL's concussion settlement fund. An extensive audit conducted by two Special Masters has estimated the financial impact of these actions to exceed $87 million.
The audit revealed that these firms collaborated with certain medical professionals to issue misleading diagnoses of Parkinson's disease. This alarming information was disclosed in a comprehensive 51-page report published on Monday. In response to the findings, an NFL spokesperson expressed satisfaction with the audit's conclusions, stating, "We are hopeful that this decision will deter future misconduct."
As part of the settlement agreement, which has been uncapped for court approval, any fraudulent activities against the fund are viewed as direct deception against the NFL itself. Consequently, the audit advises that pending claims from the five law firms and evaluations by eight doctors be denied. The NFL emphasized the necessity of the imposed remedies, citing the extensive misconduct uncovered during the investigation.
This is not the first time the concussion settlement fund has encountered controversy. In 2021, the league committed to eliminating "race-norming," a practice that disadvantaged Black players in proving cognitive impairments for benefits. Additionally, a Florida law firm faced scrutiny for allegedly manipulating doctors and falsifying medical documents.
While no criminal charges have yet been filed, the Special Masters possess the authority to refer their findings to federal law enforcement agencies for further action. The settlement fund itself is designed to provide benefits based on specific medical diagnoses, without the necessity of proving these conditions stemmed from NFL participation.
